Understanding your rights as a Tenant
The rights you have as a tenant can often seem confusing and unclear but we will provide you with straight-forward and balanced advice to help minimise your stress and worry. Before you sign any tenancy agreement, it is best to take legal advice to make sure that you are fully protected.
Your rights as a tenant include:
Tenancy Deposit Protection
Your landlord is required by law to put your deposit into a Tenancy Deposit Protection Scheme (TDP) within 30 days of your payment, in order to protect your money and ensure that it is promptly returned to you at the end of your tenancy. If your landlord ignores this legal obligation you can sue them for the return of the deposit and a sum that is up to three times the amount of your deposit.
Maintenance of the Property
The law requires that your rental property must be both safe and in a good state of repair. As part of your tenancy agreement, both you and your landlord have obligations towards the upkeep of the property. You are required to take reasonable care of the property and repair any damage that you have caused. Your landlord is also responsible for maintaining the property to an acceptable standard including carrying out repairs and ensuring that all appliances and utilities are checked and meet all health and safety standards. If your landlord doesn’t comply you may be entitled to make a claim against them.
The law will protect you if your landlord is taking advantage of you by charging excessive management or maintenance fees and a solicitor can advise you further on your specific circumstances and whether you have a claim.
Peaceful enjoyment of your property
As a tenant you have the right to peace and privacy and your landlord does not have the right to disturb you beyond reasonable communications and without a valid purpose.
If you have a tenancy agreement in place then you will be protected against any unfair rent increase or unlawful eviction. Your rent can only be increased within the term of your tenancy if you agree, otherwise your landlord must wait until the end of the existing term. You are also protected against unlawful eviction and your landlord must obtain a court order and follow a clear legal process if they wish to take possession of the property before the end of your lease.
If you are in rent arrears, it doesn’t mean that you will necessarily have to lose your home. There are a number of agencies and organisations that are able to help before or even if you are already facing eviction and one of our solicitors will be able to explain your options. There are circumstances where tenants facing rent possession proceedings in court can defend and counterclaim and we can advise you about this.
