UK Visitor Visas: Standard Visitor and Marriage or Civil Partnership Visitor

Visitor Visas Under Appendix V

If you have a family member or partner who wishes to visit you in the UK, or if you are seeking to come to the UK to visit family, for tourism, or to marry or form a civil partnership, a visitor visa may be required depending on your nationality. Visitor visa applications are refused more frequently than many people expect, and the consequences of a refusal can affect future applications. Specialist advice before you apply can make a significant difference to the outcome.

Naila Kosar is a specialist immigration solicitor with extensive experience in visitor visa applications, including cases involving previous refusals, complex family circumstances, and applications connected to a wider immigration journey. She will assess your individual circumstances carefully and advise on how to present the strongest possible application before it is submitted.

Do You Need a Visitor Visa?

Whether a visitor visa is required before travelling to the UK depends on the nationality of the person wishing to visit. Some nationalities must obtain entry clearance before travelling, while others can seek permission to enter on arrival. Many nationalities now also need to obtain an Electronic Travel Authorisation before travelling even where a full visa is not required. Naila will advise on whether a visa or other pre-travel permission is needed in your specific case.

The Standard Visitor

The Standard Visitor category is the main visitor route and covers a wide range of purposes including tourism, visiting family or friends, and carrying out certain permitted activities. It is the category most commonly used by family members wishing to visit a relative in the UK.

How Long Can a Visitor Stay?

A Standard Visitor visa can be issued with validity of up to ten years, allowing multiple visits to the UK. However, the length of any individual stay is limited regardless of the visa’s validity period, and visitors cannot use a long-term visa to live in the UK through frequent or successive visits. Each visit must be a genuine temporary stay, and the overall pattern of visits is relevant to how future applications and entries are assessed.

The Genuine Visitor Requirement

The central test for all visitor applications is whether the applicant is a genuine visitor. This is an assessment of the applicant’s intentions, their ties to their home country, their financial position, and the credibility of the purpose of their visit. It is the ground on which most visitor visa applications are refused, and it requires careful evidential preparation. Naila will advise on how to present your application to address this requirement effectively.

Previous Refusals

A previous refusal of a visitor visa does not automatically prevent a fresh application, but it does make the genuineness assessment more difficult and must be addressed directly in any subsequent application. Naila has considerable experience in advising on applications following previous refusals and will give you a clear assessment of the prospects before you proceed.

The Marriage or Civil Partnership Visitor

The Marriage or Civil Partnership Visitor category is for a person who wishes to come to the UK specifically to marry or form a civil partnership, or to give notice of their intention to do so. It is a distinct category from the Standard Visitor and has its own specific requirements. It is particularly relevant to couples where one partner is outside the UK and the couple wish to marry in the UK before making a partner visa application.

There is an important point to be aware of in this context. A Marriage or Civil Partnership Visitor cannot switch into the partner route from within the UK after the marriage or civil partnership has taken place. The applicant must leave the UK and make a fresh application for entry clearance as a spouse or civil partner from outside the UK. The timing and sequencing of these applications requires careful planning and Naila will advise on this at the outset so that unnecessary delays are avoided.
